Minutes 31st March 2015

A Meeting of Llangarron Parish Council was held on Tuesday, 31st March, 2015 at Llangarron Village Hall at 8.00 p.m. with Mr. P.J. Bailey in the Chair.

Present at the Meeting were Councillors Bailey, Brewer, Cooper, Hayward, Jones, F.J. Lane, Morehead. There were 8 members of the public present.

Apologies of absence were received from Hfds. Ward Councillor for Llangarron, Mrs. J. Hyde and Councillors Fisher and G.E. Lane.


Prior to opening meeting to public, the Chairman detailed that he would be declaring an interest in Planning Application P150460 and having taken advice from HALC he was, with approval of meeting, allowed to Chair meeting, but would not participate in discussion or have a vote. The Councillors were in agreement to follow this procedure.

D. Williams – Damage caused to verges at Llancloudy re vehicles accessing Hill Farm, Llancloudy.

Minutes of the last Meeting

The Minutes of the Meeting held on 24th February, 2015 having been previously circulated, were taken as read, confirmed and signed as a true and correct record by the Chairman.

Matters Arising

Planning Decisions:

P150180/F – Ref. DCSE2003/3083/F (Conversion of barn to provide parents accommodation) – certificate of lawful use granted December 2014 confirming use of Beech Barn as a separate dwelling (LPA ref P143167/U) Condition 10 is considered ultra vires at Tre Evan House, Llangarron, Ross on Wye, Hfds. for Mr. T. Bird. Planning Approved.
P/143626/F (Amended Plans) – Proposed erection of a two storey dwelling and garage at Land at Alamaya House, Llangrove, Ross on Wye, Hfds. for Mr. and Mrs. McConnell-Lawlor. Permission Refused.
P143663/F, P143664/F, P/143665/F, P/143666/F and P143667/F – Five interrelated applications for the erection of up to 35 hectares of fixed Spanish Polytunnels over arable crops grown on external table tops, erection of portal frame pump house with two external water tanks, erection of general purpose agricultural building, creation of elevated lorry docking/loading platform and upgrade of vehicular access to the A4137 and laying out of upgraded access road at Biddlestone Orchards, Llangarron, Ross on Wye, Hfds. for Mr. M. Green. Notice received from Hfds. Council that Application Withdrawn.

Tredunnock Farm – letters had been received from Mrs. J. Joseph and Mr. J. Thorpe in respect of applications for planning and these had been circulated to all Councillors.

Other Matters:

Annual Parish Meeting – Chairman reported that 10 members of the Electorate present, which was disappointing. Mr. D. Atkinson, Locality Steward from Balfour Beatty had been Guest Speaker and it had been an informative meeting.

Highways  Old Matters:

Up Dates – Drainage in Llangarron at Bridge – still awaiting works on this site, Lay By at A466, Llancloudy – Clerk had made contact with Mr. S. Hodges of Hfds. Council for advice on this issue. An acknowledgement had been received and it was hoped further response received prior to next meeting, Drains at A466 – Mr. Atkinson had visited the resident raising the complaint and had requested for certain works to be carried out to alleviate problems. Noted that not all work could be done requested by resident as budgets would not allow, Community Speed Gun – Details had now been received – 6 volunteers needed to be trained with 3 operating each time. Agreed Clerk to forward details to Mrs. Hayward and this item would be discussed by new Council following Elections, Damage to verges at Hill Farm, Llancloudy – following discussion in open meeting, Clerk to request Mr. Atkinson to meet local residents as matter of urgency. Hedges at Whitchurch – Mr. F. Lane reported that these had finally been cut back.

Parish Lengthsman – The Clerk advised that Mr. Griffiths had now carried out works as per estimated and Invoice received for £1110.00. At proposal of Miss Cooper and seconded by Mr. Jones agreed to pay same following checking of works completed. Two issues had arisen following the works as follows: Biddlestone Pond – owner Mr. McRobb unhappy with water being diverted into pond. Mr. D. Atkinson had been requested to visit and he agreed all in order as there was a prescriptive right to remove water from highway. The second issue was at Langstone where in landowner not happy with trench dug into gateway to direct water off road. Agreed Clerk and Mr. Griffiths would meet landowner to resolve and it was hoped that water could be piped underground with concrete pad on top. It was felt that in future prior to carrying out works a meeting should take place with landowner to agree prior to commencement. Clerk advised that new contract for 1st April still not arrived – agreed Clerk to chase and following liaising with Mr. Morehead the Clerk would issue contract to Mr. Griffiths to start as soon as possible.

Highways New Matters

Treworgan Farm Deliveries – this item had been raised at Annual Parish Meeting in that delivery lorries transporting live chickens to Treworgan were now driving through Llangarron as opposed to coming in off A466. It was reported that under original Planning Application it was agreed that access was only off A466 and not through Llangarron. Clerk to raise with Planning Enforcement and Cargill.
Parking at Llangrove School – Complaints were again being received re parents parking outside school and creating poor visibility for residents accessing junctions in that area. Agreed Clerk to write to School and Pre School and request that they encourage parents to park in Village Hall Car Park to keep road clear.


Parish Paths Scheme – The Clerk reported in Mrs. Fishers absence that various works had been carried out and that Invoice due shortly. At the proposal of Miss Cooper and seconded by Mr. Jones agreed to pay Invoice on receipt and Clerk to supply details at next meeting.

Dogs on Footpaths – The Clerk reported on letters received from both landowner and resident concerning incident on LG14 and LG18 where in a situation had arisen with regards to dogs owned by both parties. The Councillors discussed the matter at length and it was agreed that both residents walking footpaths and landowners where footpaths crossed their land had a duty to ensure their dogs were under control at all times. Clerk to put out reminders on Notice Boards, Village Newsletters and Border News reiterating this advice. The Councillors felt that if they did nothing in this instance, they could be found guilty of negligence. To this end agreed Clerk should write to landowner and request that the dog in question was kept under control and that residents were allowed to access footpaths without any problems. The Clerk would ring landowner prior to submitting letter. A letter also to be sent to the resident complaining.

Planning Applications

P150460 – Proposed installation of a wind turbine with tower hub height of up to 24.8 m and a blade tip height of up to 36.6 m including associated works at Gwenherrion Farm Welsh Newton, Monmouth for Mr. and Mrs. Morgan. The Parish Council unanimously object to this Planning Application and would endorse the letter submitted by Welsh Newton Parish Council dated 16th March, 2015.
P150650 – Proposed erection of two dwellings at land opposite Trecilla Court, Llangarron, Ross on Wye, Hfds, for Mr. and Mrs. Hitchen. The Parish Council unanimously support this Planning Application.

Neighbourhood Plan

The Clerk reported that although it had been hoped to present draft Neighbourhood Plan to the meeting following the release of the Core Strategy Modifications, adjustments would have to be made. It now appeared that new housing could be spread across all parishes within Parish Council area and it may be necessary to create Village Envelopes. It was noted that Karla Johnson, Neighbourhood Support Officer from Hfds. Council was attending next Neighbourhood meeting and hopefully would be able to give relevant guidance.


Receipts – Noted that £200 donation received from Llangrove 100 Club towards Defibrillator for Llangrove, this now meant a total of £368 held within accounts.

Payments – At proposal of Mr. Jones and seconded by Mr. F. Lane agreed to pay Llangarron Village Hall £105, Llangrove Village Hall £61, Llangrove Academy £60, all in respect of Room Hire.
At the proposal of Miss Cooper and seconded by Miss Brewer agreed to pay Clerks Salary for the period 1st January, 2015 to 31st March, 2015 in the sum of £500 less £24.60 to PAYE, giving Clerk net payment of £475.40.
At proposal of Mr. Morehead and seconded by Miss Cooper agreed to pay Clerk sum of £100 to cover costs of Provision of Home Office (this covers telephone charges, internet charges and electricity)
Chairman’s Expenses – it was noted that in past Chairman had been paid £100 towards expenses incurred. The Chairman advised that he did not wish to take payment and would prefer to see this extra amount added to Parish Lengthsman work.
At the proposal of Miss Cooper and seconded by Mrs. Hayward agreed to pay Vitalis £150 in respect of Host Fee for Web Site for 3 year period 23/3/13 to 23/3/16.

Hfds Council Core Strategy

Noted that modifications now received and agreed that all Councillors should read on line and item would be on next agenda for discussion and decision.


Noted that Elections 7th May, 2015 and that Clerk had nomination packs. Deadline for submission was 9th April, 2015.

Any Other Business

Site of Old Workshop at Llangrove – Mr. Jones queried when work was starting and other Councillors agreed that site was an eyesore. Agreed Clerk to speak to owners and query start date.

Symonds Trewen Farm – Mr. Jones raised concern that fields appeared to becoming a dumping area, but it was considered that nothing could be done as all within curtilage of landowner’s property.

There being no further business, the Meeting was closed by the Chairman at 9.14 p.m.
